Terms of Service
These Terms of Service ("Terms") govern your use of the website at obzdn.co and the software products offered by OBZDN Group LLC ("OBZDN," "we," "us," or "our"), including the Foreman iOS application (together, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1.Acceptance of Terms
By using the Services, you confirm that you are at least 18 years old, or the age of majority where you live, and that you have the authority to accept these Terms on behalf of yourself or the organization you represent.
2.Use of the Services
We grant you a limited, non-exclusive, non-transferable, and revocable right to use the Services for their intended purpose. You agree to use the Services lawfully and responsibly. You will not:
- Use the Services in any way that violates applicable law or the rights of others.
- Attempt to gain unauthorized access to the Services or their systems.
- Interfere with, disrupt, or place undue load on the Services.
- Copy, modify, reverse engineer, or resell the Services except as permitted by law.
3.Your Content
You retain ownership of the content you capture and submit through the Services, including photos, audio, transcripts, and job records. You grant OBZDN the limited rights needed to host, process, and display that content so we can provide the Services to you, such as producing structured documentation. You are responsible for ensuring you have the right to capture and submit that content.
4.Foreman and iOS Distribution
Foreman is an OBZDN Group LLC product intended for distribution through the Apple App Store for iOS. Where and when you use Foreman on Apple devices, your use is also subject to Apple's applicable terms. OBZDN, not Apple, is solely responsible for the Foreman application and its content, and for providing any support and warranties described here.
5.Intellectual Property
The Services, including their software, design, text, and the OBZDN and Foreman names and logos, are owned by OBZDN Group LLC and protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, no rights are transferred to you.
6.Disclaimers
The Services are provided on an "as is" and "as available" basis. Foreman is a documentation aid and does not replace professional judgment, licensing requirements, or code compliance. You are responsible for reviewing and verifying any records the Services help you create. To the fullest extent permitted by law, OBZDN disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
7.Limitation of Liability
To the fullest extent permitted by law, OBZDN Group LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business, arising from or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us, if any, for the Services in the twelve months before the claim.
8.Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we need to protect the Services or other users. Provisions that by their nature should survive termination will continue to apply.
9.Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law rules. You agree that any dispute relating to the Services will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
10.Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date above. If changes are significant, we will provide a more prominent notice. Your continued use of the Services after an update means you accept the revised Terms.
